Terms of Service

These terms cover using Holistay as a guest or as a host. They are written to be read, and they say plainly where our responsibility ends.

1. Who we are, and what this service is

Holistay is operated by Webshot, Sint Hubertse Binnenweg 49, 5454 GA Sint Hubert, the Netherlands (KvK 51317915, VAT NL002515432B15). You can reach us at hello@holistay.io.

Holistay is a listing and introduction platform. Hosts publish properties, guests find them and agree terms directly with the host. We are not a party to the rental agreement, we do not own or manage any property, and we do not act as an agent for either side.

That distinction matters for what you can expect from us, and it is set out honestly below rather than buried.

2. We do not handle your money

Holistay currently processes no payments. We take no deposit, hold no funds, and issue no refunds, because no money passes through us at any point.

Whatever is paid, and how, is agreed between guest and host directly. This has a consequence worth stating plainly: we cannot recover a payment for you, reverse one, or adjudicate a dispute about one. If a host asks for a deposit, you are sending money to that person on their terms, with the protections of your own payment method and nothing more from us.

We say this because the alternative — implying a protection that does not exist — is how people get hurt. If we introduce payments, these terms will change and you will be told before they apply to you.

3. Accounts

Accounts are created with an email address and a sign-in link; there is no password to lose. Anyone with access to that mailbox can sign in as you, so treat it accordingly.

You must be old enough to enter a binding contract where you live. One person, one account, and the details on it must be true.

4. If you are a host

You are responsible for the accuracy of everything you publish: the property, the photographs, the video tour, the price, the availability and the noise assessment. Guests make decisions on that basis, and a listing that misrepresents a property may be removed.

Every listing requires a video tour. This is the point of the platform, not a formality. A listing that has published without one is marked as incomplete and returns to draft if a video is not added within the stated period.

You are responsible for your own legal position, and it is not a small list:

  • Registration, licensing and permits for short-term letting where your property is
  • Any limits your building, lease, condominium rules or mortgage place on letting
  • Tourist taxes, income tax and VAT
  • Insurance appropriate to letting the property to guests
  • Safety obligations — smoke alarms, gas and electrical checks, whatever applies locally

5. If you are a guest

A booking or an accepted offer is an agreement between you and the host. Read what the host says about cancellation, deposits, house rules and check-in before you commit, and keep your own record of it.

Watch the video tour. It exists so that what you see is what you get, and it is the best protection available to you on this platform.

Treat the property and the neighbours as you would want a guest to treat yours.

6. Price negotiation

Where a host has enabled it, you can offer a price rather than pay the listed one. Offers pass back and forth until one side accepts or declines.

An accepted offer creates a booking at that amount and blocks those dates on the host’s calendar. Treat an offer as one you intend to honour; both sides can decline at any point before acceptance.

7. Listings we prepared from a public website

Some listings are drafted by us from a property owner’s own public website and sent to that owner to review. A draft prepared this way is not visible to anyone else and is never published unless the owner approves it.

If you received a link to one and it is not your property, or you would rather we did not hold it, the same link removes everything we prepared. We keep a record that it was removed so that we do not repeat it.

8. Content you post

You keep ownership of your photographs, video links and text. You give us permission to display them on Holistay and to use them to promote your listing and the platform, for as long as the listing is published and for a reasonable period afterwards.

You must have the right to post whatever you post. Photographs taken by a photographer you hired are frequently not yours to license — check before uploading them.

We may remove content that is unlawful, misleading, or that misrepresents a property.

9. What we do not promise

We provide the platform as it is. We do not guarantee that it will be available without interruption, that a listing is accurate, that a host or guest is who they say they are, or that a stay will meet your expectations.

Destination guides, earnings estimates, safety ratings, health notes and visa information are orientation, not advice. Entry rules and health requirements in particular change often, and the official source linked on each guide is the authority, not us.

To the extent the law allows, we are not liable for the conduct of hosts or guests, for the condition of a property, or for money you pay to another user. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

10. Ending it

You can close your account whenever you like, by writing to us. We can suspend or close an account that breaks these terms, misrepresents a property, or puts other people at risk.

Bookings already agreed remain a matter between the guest and the host.

11. Changes, law and complaints

We will post any change here and update the date at the top. Continuing to use Holistay after a change means you accept it; if you do not, stop using the service and tell us at hello@holistay.io.

These terms are governed by the law of the Netherlands. If you are a consumer, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings there.

Tell us about a problem first — hello@holistay.io — because most things are settled that way. EU consumers may also use the European Commission’s online dispute resolution platform.
